ROOST
Terms of Service
Effective Date: August 13, 2026
For users aged 18 and over
Service Contact: service@roost.pet
These Terms of Service, referred to as the "Terms," govern your access to and use of the Roost mobile application and any related websites, features, content, products, or services that link to these Terms, collectively referred to as the "Services."
Roost is an adult social communication service that may allow users to discover recommended profiles, initiate one-to-one video calls, participate in random video matching, follow other users, exchange text messages, submit User-Generated Content, and use paid or promotional features where offered.
These Terms form a legally binding agreement between you and the developer or legal entity identified as the provider of Roost in the applicable app store listing, referred to in these Terms as "Roost," "we," "us," or "our."
By creating an account, selecting an acceptance control, accessing the Services, or continuing to use the Services, you confirm that you have read, understood, and agreed to these Terms.
If you do not agree to these Terms, do not create an account, purchase any paid feature, or access or use the Services. You may stop using Roost and request account deletion as described in Section 18.
Your use of Roost is also subject to policies and notices made available through the Services, including:
• The Roost Privacy Policy.
• The Roost Community Guidelines.
• Published child safety and CSAE standards.
• Any feature-specific rules, promotion rules, purchase disclosures, or regional notices.
• Applicable app store terms and payment rules.
These documents are incorporated into these Terms to the extent stated in them. If a feature-specific rule conflicts with a general provision of these Terms, the more specific rule will apply to that feature, subject to applicable law.
You represent that you have the legal capacity to enter into these Terms. If you use Roost on behalf of a company or other organization, you represent that you are authorized to bind that organization, and references to "you" will include that organization where appropriate.
Nothing in these Terms excludes or limits rights that cannot lawfully be excluded or limited, including mandatory consumer rights in your country or region. If a provision conflicts with mandatory law, that provision will apply only to the maximum extent permitted, and the remaining provisions will continue in effect.
You agree that your electronic acceptance of these Terms has the same legal effect as a handwritten signature where recognized by applicable law. You may save or print a copy of these Terms for your records.
Roost is intended exclusively for individuals who are at least 18 years old. A person under 18 may not create an account, access video matching, participate in communications, purchase virtual items, or otherwise use the Services.
By creating an account or using Roost, you represent and warrant that:
• You are at least 18 years old.
• You meet any higher minimum age required by the law of your jurisdiction.
• You are legally permitted to use an adult social communication service.
• You have not been prohibited from using the Services by applicable law or a prior valid enforcement action.
Providing false age information is a material breach of these Terms and may result in immediate restriction, suspension, or termination.
Roost may request age-related information or use reasonable age assurance measures, including date-of-birth confirmation, account review, risk signals, a selfie, a short video, an identification document, or an authorized verification provider where legally permitted.
Any age assurance process will be conducted in accordance with the Roost Privacy Policy and any additional notice presented at the time of collection. Roost may restrict access while a verification is pending or if the information provided appears false, altered, inconsistent, or insufficient.
If Roost reasonably suspects that an account belongs to a person under 18, Roost may:
• Request age verification.
• Temporarily restrict video, messaging, matching, purchase, or account features.
• Remove the profile from recommendations.
• Preserve information needed for a safety review.
• Suspend or terminate the account.
• Delete associated information subject to legal, safety, fraud-prevention, and evidence-preservation requirements.
A parent, legal guardian, or other person who believes that a minor is using Roost may contact service@roost.pet. The report should include enough information to identify the relevant account without unnecessarily disclosing additional information about the minor.
Roost has zero tolerance for Child Sexual Abuse and Exploitation (CSAE) and Child Sexual Abuse Material (CSAM). These prohibitions apply even though Roost is an adults-only service.
CSAE includes conduct that sexually exploits, abuses, endangers, grooms, coerces, traffics, or otherwise harms a child. CSAM includes any material that depicts or facilitates the sexual abuse or exploitation of a child, as defined by applicable law.
You must not use Roost to:
• Create, possess, request, upload, transmit, distribute, promote, or facilitate CSAM.
• Groom or attempt to groom a child for sexual purposes.
• Engage in sexual communication with a child.
• Arrange or facilitate sexual contact involving a child.
• Engage in sextortion, trafficking, or sexual exploitation involving a child.
• Sexualize a person known or reasonably suspected to be under 18.
• Share links, instructions, or tools intended to locate, create, or distribute CSAM.
• Encourage, normalize, conceal, coordinate, or assist CSAE.
• Threaten or coerce a child to provide sexual content.
• Impersonate a minor for the purpose of exploitation or abuse.
Any credible indication of this conduct may result in immediate account termination and reporting to competent authorities or authorized child protection organizations.
Users may report a child safety concern through available in-app reporting tools or by contacting service@roost.pet. Do not download, reproduce, forward, or create additional copies of suspected CSAM for reporting purposes. Use the reporting controls to identify the account, interaction, or content without redistributing the material.
If a child or another person is in immediate danger, contact the appropriate local emergency service or law enforcement authority directly. Roost is not an emergency response service.
When Roost becomes aware of suspected CSAE or CSAM, it may restrict access, preserve relevant account records and evidence, conduct automated or human review, engage qualified service providers, and cooperate with lawful investigations.
Where required or permitted by law, Roost may report relevant information to law enforcement authorities, national or regional reporting centers, child protection organizations, regulators, emergency services, or other legally authorized recipients.
Child Safety Email: service@roost.pet
This contact may be used by users, regulators, law enforcement authorities, child protection organizations, and app store representatives for CSAE standards and child safety compliance inquiries.
Roost will not take action against a user solely because a good-faith child safety report is not ultimately confirmed. However, knowingly false, fabricated, retaliatory, or abusive reports may result in enforcement action.
To use certain Services, you may need to create an account and provide accurate, current, and complete information, which may include a display name, email address, telephone number, date of birth, profile information, and authentication credentials.
You must promptly update information that becomes inaccurate or incomplete. Roost may rely on the information associated with your account when providing notices, verifying requests, and protecting account security.
Unless Roost expressly permits otherwise, you may maintain only accounts that genuinely represent you. You must not:
• Create an account for another person without lawful authorization.
• Impersonate another person or organization.
• Create deceptive, duplicate, or disposable accounts to evade restrictions.
• Misrepresent your age, identity, location, affiliation, or intentions.
• Buy, sell, rent, lease, or transfer an account.
You are responsible for maintaining the confidentiality and security of your password, verification codes, authentication tokens, and device access. You must use reasonable safeguards, including a unique password and a secure device lock where available.
You must not share authentication codes or permit another person to use your account. Activity conducted through your account may be treated as authorized by you until Roost receives and processes notice of unauthorized access, except where applicable law provides otherwise.
If you suspect that your account or device has been compromised, immediately:
• Change your password where available.
• Secure the email address or telephone number associated with the account.
• End unauthorized sessions through available settings.
• Contact service@roost.pet.
Roost may temporarily lock or restrict an account while investigating a security concern.
Roost may request information reasonably necessary to verify account ownership, age, identity, or the authenticity of an account. Verification does not constitute a background check, endorsement, or guarantee concerning a user.
Failure to complete a reasonable verification request may result in limited access, suspension, or inability to recover or delete an account where ownership cannot be established.
If you use a third-party authentication service, you authorize Roost and that provider to exchange the information necessary to create, authenticate, and maintain your Roost account, subject to the Roost Privacy Policy and the provider's own terms.
Roost does not control the availability of a third-party sign-in service. You are responsible for maintaining access to the third-party account and complying with its rules.
Roost may send authentication messages, security alerts, call or message notifications, safety notices, purchase receipts, policy notices, and other service communications to the contact information or device associated with your account.
You may manage optional notifications through the App or device settings. You may still receive communications that are necessary for account security, legal compliance, transactions, or service operation.
Your Roost account and the limited rights granted to you are personal and non-transferable. Unless required by law, no person has a right to access or inherit your account, profile, messages, virtual items, or purchase history after your death or incapacity.
You are responsible for activity conducted through your account to the extent permitted by law. You must cooperate reasonably with investigations of suspected unauthorized access, fraud, or misuse and must not conceal or destroy relevant information.
Subject to these Terms, Roost grants you a personal, limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to download, install, and use one object-code copy of the App on a device that you own or control, solely for your lawful personal use of the Services.
Roost and its licensors retain all rights not expressly granted in these Terms. No ownership interest in the App, software, Services, algorithms, designs, databases, trademarks, or other Roost materials is transferred to you.
Except where applicable law expressly permits the activity despite this restriction, you must not:
• Copy, modify, translate, adapt, or create derivative works of the App.
• Reverse engineer, decompile, disassemble, or attempt to derive source code.
• Circumvent access controls, security features, usage limits, or technical protections.
• Probe, scan, test, or exploit a vulnerability without prior written authorization.
• Use bots, scripts, crawlers, scrapers, emulators, or automated systems to access the Services.
• Extract, harvest, index, or compile user information or content at scale.
• Interfere with servers, networks, calls, messages, matching, or another user's access.
• Introduce malware, malicious code, or harmful files.
• Use the Services to develop, train, benchmark, or improve a competing service without written permission.
• Remove copyright, trademark, attribution, or proprietary notices.
• Rent, lease, sell, sublicense, distribute, or commercially exploit the App or any access right.
Roost may provide updates, patches, security fixes, or new versions. Certain updates may be required to continue using the Services. You are responsible for compatible devices, operating systems, network access, and data charges.
Roost is not responsible for reduced functionality caused by an unsupported device, outdated operating system, unavailable network, or failure to install a required update.
If you obtain the App from Google Play, Apple App Store, or another distributor, your use is also subject to that distributor's terms. The distributor may have enforcement rights as a third-party beneficiary of the license provisions applicable to its platform where its terms so provide.
You may use the Services only where they are lawfully available. You are responsible for complying with laws applicable to your access, communications, content, purchases, and conduct, including sanctions, export controls, consumer protection, privacy, recording, and intellectual property laws.
If you provide ideas, suggestions, or feedback concerning Roost, you grant Roost a worldwide, perpetual, irrevocable, royalty-free, transferable, and sublicensable right to use that feedback for any lawful purpose without compensation or attribution. This provision does not transfer ownership of unrelated User-Generated Content.
The App may include open-source software governed by separate licenses. If an open-source license conflicts with these Terms regarding a specific component, the open-source license will control for that component.
Depending on your device, region, account status, and the current version of Roost, the Services may include:
• A recommendation page displaying user profiles.
• The ability to initiate a one-to-one video call from a recommended profile.
• Random matching for one-to-one video calls.
• Follow and unfollow functions.
• Text messaging with followed or otherwise eligible users.
• Blocking, reporting, muting, filtering, and safety controls.
• Notifications, promotions, virtual items, subscriptions, or other paid features where offered.
Roost does not guarantee that every feature will be available to every user, device, language, country, or region. Features may depend on technical capacity, user demand, local law, platform rules, age assurance, safety status, account history, and operational considerations.
The recommendation page may allow you to invite another user to a video call. The displayed user is not required to accept. A recommendation is generated from available information and signals and does not represent verification, endorsement, compatibility, or a promise that an interaction will occur.
Random matching is intended to create spontaneous one-to-one video connections. Matching may be filtered or adjusted based on availability, language, region, network quality, stated preferences, prior blocks, enforcement status, safety signals, legal restrictions, and other operational factors. It may therefore not be mathematically uniform or based solely on chance.
Roost may allow you to follow other users and initiate text conversations with eligible accounts. A follow does not create a legal, personal, professional, or fiduciary relationship and does not imply endorsement by Roost or the followed user.
Messaging eligibility, history, delivery, and availability may depend on account settings, blocks, technical status, moderation, and feature design.
Roost may test, add, modify, suspend, limit, or discontinue features, interfaces, eligibility rules, or technical systems. Some users may receive experimental features or different versions. Roost is not required to make an experimental feature generally available.
The Services may be unavailable because of maintenance, upgrades, emergencies, security incidents, network failures, provider outages, legal requirements, or events beyond Roost's reasonable control. Roost will use reasonable efforts to maintain the Services but does not guarantee continuous or error-free availability.
Before using a feature, you may be presented with additional disclosures, consent requests, purchase terms, safety notices, or community rules. Your use of that feature constitutes acceptance of the applicable additional terms where legally valid.
Except where a paid commitment or mandatory law provides otherwise, Roost has no obligation to continue any feature, maintain a particular design, preserve a specific matching method, or support an outdated App version.
You must use Roost in a lawful, respectful, and authentic manner. You are responsible for your conduct, communications, User-Generated Content, and interactions with other users.
You must not use the Services to:
• Violate applicable law, these Terms, or an incorporated policy.
• Harm, exploit, deceive, intimidate, or endanger another person.
• Facilitate a crime or conceal evidence of unlawful activity.
• Interfere with another person's access to or enjoyment of the Services.
• Encourage or assist another person to violate these Terms.
You must not share or display:
• Any sexual content involving or appearing to involve a person under 18.
• Non-consensual intimate content or sexualized images shared without lawful permission.
• Sexual exploitation, coercion, sextortion, trafficking, or solicitation.
• Unwanted sexually explicit content or conduct directed at another user.
• Content that violates applicable obscenity, pornography, or age-restriction laws.
Adult nudity or sexual content may also be prohibited or restricted by the Community Guidelines, feature rules, app store policies, or local law. You are responsible for reviewing and following the rules presented in the App.
You must not engage in harassment, bullying, stalking, intimidation, threats, humiliation, targeted abuse, or unwanted repeated contact. You must not promote hatred, dehumanization, or discrimination based on a protected characteristic.
You must not credibly threaten violence, promote terrorism, coordinate violent wrongdoing, glorify serious harm, or encourage another person to engage in self-harm. Content intended for awareness, support, or prevention may be evaluated in context.
If you believe a person faces immediate danger, contact the appropriate local emergency service. Roost is not able to provide emergency intervention.
You must not:
• Misrepresent your identity, age, location, relationship, or intentions.
• Solicit money through deception or manipulate another user into a transaction.
• Conduct phishing, credential theft, investment fraud, romance scams, or payment scams.
• Promote counterfeit goods, illegal services, pyramid schemes, or deceptive opportunities.
• Use another person's photographs or identity without authorization.
• Falsely claim affiliation with Roost, a government, a business, or another organization.
You must not disclose another person's home address, precise location, identification number, financial information, login credentials, medical information, private communications, or other sensitive personal information without lawful authorization.
You must not record, screenshot, copy, publish, or redistribute another user's private communication in violation of applicable law or the person's rights.
You must not send spam, repetitive solicitations, unsolicited advertising, chain messages, or malicious links. You must not artificially manipulate follows, recommendations, matches, reports, engagement, or virtual-item activity.
Unauthorized bots, scripts, scraping, automated messaging, account farms, device farms, and coordinated evasion are prohibited.
You must not use Roost to buy, sell, solicit, promote, or facilitate illegal drugs, weapons, trafficking, prostitution where unlawful, stolen property, unlawful gambling, money laundering, or another regulated or prohibited transaction.
Roost may consider credible off-platform conduct when it creates a substantial risk to users or the Services, including violence, trafficking, CSAE, sextortion, stalking, fraud, or coordinated abuse connected to a Roost account or interaction.
You are responsible for obtaining any consent required before recording, capturing, or redistributing a video call, audio communication, message, or image. Roost's technical ability to capture or report content does not grant you a legal right to record another person.
Use caution when communicating with people you do not know. Do not share passwords, authentication codes, financial details, identification documents, home addresses, or other highly sensitive information. If you choose to meet another user in person, make an independent safety assessment, meet in an appropriate public place, inform a trusted person, and follow local safety guidance.
Roost does not supervise user interactions and cannot guarantee another user's identity, background, intentions, or conduct.
"User-Generated Content" or "UGC" means content that a user creates, uploads, transmits, publishes, displays, or submits through the Services, including profile photographs, profile descriptions, text messages, images, media, comments, reports, feedback, and other communications.
Live audio and video transmitted during a call may also be treated as UGC for purposes of conduct, safety, and rights, even when Roost does not routinely record or permanently store the call content.
You are solely responsible for your UGC and the consequences of creating, sharing, or displaying it. You represent and warrant that your UGC:
• Is accurate where it states a fact about you.
• Complies with these Terms and applicable law.
• Does not infringe intellectual property, privacy, publicity, contractual, or other rights.
• Does not contain another person's information or content without required permission.
• Is not fraudulent, malicious, unlawful, or designed to cause harm.
As between you and Roost, you retain any ownership rights that you lawfully hold in your UGC. These Terms do not transfer ownership of your original UGC to Roost.
You acknowledge that UGC may incorporate materials owned by others and that your rights are limited by their rights, applicable licenses, and law.
When you submit UGC, you grant Roost a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, transmit, process, adapt for technical formatting, display, communicate, and otherwise use that UGC only as reasonably necessary to:
• Provide and operate the Services.
• Deliver content to the audience you select.
• Maintain compatibility, availability, and quality.
• Moderate content and enforce these Terms.
• Investigate reports, protect users, and prevent abuse.
• Comply with legal obligations and valid legal requests.
• Establish, exercise, or defend legal claims.
This license continues for as long as the UGC is available through the Services and for a reasonable period afterward where copies remain in backups, reports, legal records, safety systems, or content previously shared with other users.
The visibility of UGC depends on the feature, your settings, and the audience you choose. Profile information may be visible to recommended users. Messages are visible to conversation participants. Content submitted with a report may be reviewed by authorized personnel, service providers, or legally authorized recipients.
Recipients may capture, copy, record, or redistribute content outside Roost's control. Privacy settings can reduce the intended audience but cannot guarantee that a recipient will not retain or share the content.
You must not submit UGC that:
• Contains CSAE, CSAM, or sexual content involving a minor.
• Contains non-consensual intimate content.
• Promotes violence, terrorism, trafficking, or serious criminal activity.
• Harasses, threatens, stalks, or targets another person.
• Promotes hate or unlawful discrimination.
• Infringes copyright, trademark, privacy, publicity, or other rights.
• Discloses another person's private or sensitive information without authorization.
• Contains malware, phishing, scams, spam, or deceptive links.
• Impersonates another person or misrepresents its source.
• Is otherwise prohibited by law, these Terms, or the Community Guidelines.
Roost may review, restrict, block, remove, preserve, or decline to distribute UGC when it reasonably believes the content may violate these Terms, create risk, infringe rights, or expose Roost or another person to legal liability.
Roost may act based on automated tools, human review, user reports, legal notices, service-provider signals, or other relevant information. Moderation systems may make mistakes and are not guaranteed to identify every violation.
You may delete certain UGC through available product controls. Deletion from your interface may not remove:
• Content already delivered to or copied by another user.
• Screenshots or recordings created by another person.
• Content shared outside Roost.
• Information preserved in a safety report or legal record.
• Restricted backup copies awaiting scheduled deletion.
• Information that Roost must retain for legal, fraud-prevention, safety, or dispute purposes.
Unless Roost expressly agrees otherwise in writing, UGC submitted to the Services is not treated as confidential. Do not submit trade secrets, confidential business information, or highly sensitive personal information that is not necessary for the relevant feature.
To the extent permitted by law, you consent to technical modifications necessary to transmit, resize, encode, format, display, moderate, or make your UGC compatible with the Services. Roost does not claim a right to materially change the meaning of your UGC for an unrelated purpose.
Where moral rights cannot be waived, you agree not to assert them in a manner that prevents the authorized operation of the Services, to the extent permitted by law.
UGC submitted as part of a report may be retained and reviewed for safety, enforcement, appeal, legal, and compliance purposes. You must submit only evidence reasonably relevant to the report and must not use reporting tools to redistribute prohibited material or harass another person.
Roost is not obligated to publish, distribute, maintain, or back up UGC, except as required by applicable law or an express paid-service commitment. You should retain your own lawful copies of content that you need.
The Services, excluding UGC owned by users, contain software, interfaces, designs, text, graphics, logos, icons, audio, video, databases, algorithms, trademarks, and other materials owned by or licensed to Roost. These materials are protected by intellectual property and other laws.
The Roost name, logo, product appearance, and related marks are trademarks or trade dress of Roost or its licensors. You may not use them in a way that suggests endorsement, affiliation, or sponsorship without prior written permission.
If you believe that content available through Roost infringes your copyright, send a notice to service@roost.pet containing:
• Your full name and contact information.
• Identification of the copyrighted work claimed to have been infringed.
• Identification and location of the allegedly infringing material.
• A statement that you have a good-faith belief that the use is not authorized by the rights holder, its agent, or law.
• A statement that the information in the notice is accurate and that you are authorized to act for the rights holder.
• Your physical or electronic signature.
Roost may request additional information reasonably necessary to evaluate the notice.
If your content was removed because of a copyright complaint and you believe the removal was a mistake or misidentification, you may submit a counter-notice to service@roost.pet containing the information required by applicable law.
Submitting a false copyright notice or counter-notice may create legal liability. Roost may forward a valid notice or counter-notice to the affected parties as required or permitted by law.
Roost may suspend or terminate accounts that repeatedly or seriously infringe intellectual property rights. Roost may also restrict access to disputed content while a complaint is reviewed.
You may not copy, download, record, publish, sell, license, or otherwise exploit another user's content unless you have lawful permission or an applicable legal exception. Access to content through Roost does not grant you ownership or an unrestricted reuse right.
The Services may display content or technology licensed from third parties. Your use of that material may be subject to additional license terms. Roost does not grant rights that it does not possess.
Roost and affected rights holders retain all remedies available under contract, intellectual property, unfair competition, privacy, and other applicable laws.
Video calls and messages are initiated, accepted, declined, or sent by users. You are responsible for deciding whether to communicate with another user and for the content you show, say, or send.
When you initiate or accept a video call, you authorize Roost and its communication service providers to process and transmit live video, audio, and connection data as necessary to establish and maintain the call.
Camera and microphone access requires the relevant device permissions. You may disable a permission, but doing so may prevent the associated feature from functioning.
Roost does not routinely record or permanently store the content of private video calls. Call metadata, such as participants, invitation status, connection time, duration, network quality, and safety actions, may be processed and retained as described in the Privacy Policy.
Limited call-related content may be preserved when a user submits evidence, a disclosed safety feature captures relevant information, preservation is necessary to address a serious safety incident, or law requires it.
Roost may store text messages and supported attachments to deliver them, synchronize conversations, display history, prevent abuse, investigate reports, and comply with law. Message availability and retention are governed by the Privacy Policy and product controls.
Deleting a message from your interface may not delete a copy already delivered to another user or preserved for a legitimate safety, legal, or compliance purpose.
When you communicate, the other participant may receive or view:
• Your display name and profile photograph.
• Information visible on your profile.
• Your live video and audio during a call.
• Messages, media, and attachments that you send.
• Call invitation, connection, and message status.
• Information that you voluntarily reveal during the interaction.
Use caution because Roost cannot control what another user remembers, captures, copies, records, or rediscloses.
You must not record, screenshot, reproduce, publish, or commercially exploit another user's private communication without the permission required by applicable law. In jurisdictions requiring all-party consent, you must obtain that consent before recording.
If you report a call, message, or user, Roost may ask you to submit relevant metadata, message excerpts, screenshots, recordings lawfully created or received by you, or a description of the incident.
Roost may use this information to investigate, protect users, enforce policies, preserve evidence, respond to an appeal, or comply with law.
Roost may use account review, safety tools, or optional verification, but does not guarantee the identity, age, background, criminal history, intentions, or truthfulness of another user. A badge, completed verification step, recommendation, follow, or successful match is not an endorsement.
Roost does not arrange, supervise, or control meetings outside the Services. If you choose to meet another user, you assume responsibility for making an independent safety assessment and taking appropriate precautions.
You may use available controls to block, mute, unfollow, hide, or report another account. A block may prevent ordinary profile visibility or communication, but Roost may retain a limited record of the block to maintain safety and prevent renewed contact.
Roost may organize or rank profiles using information such as region, language, age eligibility, profile details, preferences, activity, prior interactions, availability, network quality, and safety signals.
The order of profiles is determined by automated and operational factors and does not represent a popularity ranking, verification, endorsement, or guarantee of compatibility.
Random matching is designed to introduce eligible users who are available for a video call. To operate safely and reliably, Roost may exclude or prioritize accounts based on blocks, region, language, device compatibility, connection quality, legal restrictions, risk signals, or enforcement status.
Accordingly, random matching may not produce a match immediately and may not be based on equal mathematical probability among all users.
Roost may personalize recommendations, matching, language, notifications, and feature presentation based on your settings and use of the Services, as described in the Privacy Policy.
You may influence personalization through available profile, preference, permission, follow, block, and discovery controls.
Roost may reduce visibility, delay a match, exclude an account, or require verification when an account is associated with credible reports, repeated unwanted behavior, suspected automation, possible underage use, account compromise, prior enforcement, or other risk indicators.
A safety restriction does not necessarily mean that Roost has made a final determination that a violation occurred.
Roost does not guarantee:
• That a recommended user will be available or respond.
• That a user will accept a call or message.
• That a random match will occur within a particular time.
• That a match will be compatible, enjoyable, safe, or successful.
• That recommendations or social connections will remain continuously available.
Preferences are applied subject to feature availability, safety, legal, and technical considerations. Roost does not guarantee that every recommendation or match will satisfy every stated preference.
A follow, follower relationship, or connection is a product feature only. It does not create an agency, employment, partnership, fiduciary, romantic, or other legal relationship.
Roost may remove or modify follow relationships when necessary to process a block, account deletion, safety action, technical correction, or legal requirement.
You must not manipulate recommendation or matching systems through bots, false accounts, coordinated reporting, device farms, automated activity, payment fraud, or other deceptive methods.
Roost may modify the signals, weighting, eligibility criteria, and operational logic used for recommendations and matching. Roost is not required to disclose confidential algorithms, security controls, or information that could facilitate manipulation.
Roost may offer paid features, subscriptions, virtual items, virtual currency, boosts, gifts, credits, or other digital benefits, collectively referred to as "Paid Features." Paid Features may vary by device, account, country, region, and app store.
If Roost does not currently offer a Paid Feature, the provisions of this Section apply if and when that feature becomes available.
Before a purchase is completed, the applicable checkout interface will display the price, currency, taxes where calculated, recurring nature if any, principal benefit, and other material terms required by law or app store policy.
Prices may differ by region, platform, exchange rate, promotion, bundle, or tax treatment. A lower price offered elsewhere does not entitle you to a refund or price adjustment unless required by law.
Virtual items and virtual currency are licensed, not sold. A purchase grants you a limited, personal, revocable, non-exclusive, non-transferable right to use the item only within the Services and only as permitted by the applicable feature rules.
Virtual items:
• Have no cash value.
• Are not legal tender, stored value, a bank deposit, or an investment.
• Cannot be redeemed for money, property, or services outside Roost.
• Cannot be transferred, traded, sold, or exchanged except through an expressly authorized feature.
• May not be used for wagering or a chance to win money or real-world value.
If Roost offers virtual currency, the balance shown in your account represents the scope of your limited license to use eligible digital features. It does not represent money held on your behalf.
Roost may correct a balance affected by error, fraud, chargeback, duplicate credit, unauthorized transaction, or violation of these Terms. Roost will not remove a lawfully purchased balance arbitrarily.
If a gifting feature is offered, a gift may provide a visual effect, recognition, or other digital benefit to the recipient. Unless the feature expressly states otherwise, a recipient cannot redeem a gift for cash and acquires no ownership interest in the amount paid by the sender.
You must not use gifts to facilitate fraud, money laundering, coercion, harassment, sexual exploitation, illegal transactions, or payment outside authorized channels.
Roost will disclose any material expiration rule for purchased virtual items where required by law. Promotional or complimentary credits may expire according to the promotion terms.
If local law prohibits expiration of a purchased balance, the applicable balance will be handled in accordance with that law.
If Roost offers a subscription, it may automatically renew for successive periods unless canceled before the renewal date. The checkout interface will disclose the billing period, price, renewal terms, and cancellation method.
You can manage or cancel an app-store subscription through the account settings of the store that processed the purchase. Deleting the App or your Roost account may not automatically cancel an app-store subscription. You must follow the cancellation method provided by the billing platform.
A trial or introductory offer may be limited to eligible users and may convert to a paid subscription unless canceled before the disclosed deadline. Roost or the billing platform may require a valid payment method and may prevent repeated use of introductory offers.
You are responsible for applicable taxes, mobile data charges, messaging charges, and internet fees, except taxes that Roost is legally required to pay without passing them to you.
Roost may modify or discontinue a Paid Feature. If a change materially reduces a prepaid benefit, Roost will provide a remedy required by applicable law, which may include continued access for the paid period, a substitute benefit, a proportional refund, or another appropriate solution.
You must not buy or sell Roost accounts, virtual items, balances, gifts, subscriptions, or purchase access through unauthorized channels. Roost may invalidate items obtained through fraud, resale, stolen payment instruments, or a violation of these Terms.
If your account is suspended or terminated for a material violation, you may lose access to unused virtual items and Paid Features to the extent permitted by law. Mandatory refund and consumer rights remain unaffected.
A purchase is complete when the authorized billing platform confirms the transaction. You agree to review the item, price, billing period, currency, and account before confirming payment.
Purchases made through Google Play, Apple App Store, or another app store are processed by that store. The store's payment, cancellation, and refund terms apply in addition to these Terms.
Roost generally does not receive or store your full payment card number when a store processes the transaction.
You represent that you are authorized to use the selected payment method. You authorize the applicable billing provider to charge the disclosed price, recurring fees, and applicable taxes.
You must provide accurate billing information and promptly update expired or invalid payment details. Roost or the billing provider may suspend a Paid Feature if a payment fails or is reversed.
Except where applicable law or the applicable app store policy provides otherwise, completed purchases of immediately delivered digital items are final and non-refundable.
For a purchase processed by an app store, submit the refund request through that store's refund process. If Roost directly processes a purchase, contact service@roost.pet with the account identifier, transaction reference, purchase date, item, and reason for the request.
Nothing in these Terms limits a statutory cancellation, withdrawal, refund, repair, replacement, or price-reduction right. Where law requires your express consent to immediate delivery of digital content and acknowledgment of the effect on a withdrawal right, the checkout process will request that consent and acknowledgment.
Report a mistaken or unauthorized purchase promptly to the billing platform and service@roost.pet. Roost may request information reasonably necessary to verify the account and transaction.
Roost may restrict the affected account or virtual balance while investigating fraud, but will not require you to provide a full payment card number through ordinary email or support channels.
If a charge is reversed, refunded, or charged back, Roost may remove the associated virtual items or access and correct the account balance. A fraudulent or abusive chargeback may result in purchase restrictions or account enforcement.
This provision does not prevent you from exercising a lawful right to dispute an unauthorized or incorrect charge.
If payment is confirmed but the Paid Feature is not delivered within a reasonable period, contact service@roost.pet or the applicable app store. Roost may investigate, restore the item, provide an equivalent benefit, or issue a refund where appropriate.
Cancellation stops future renewal charges but ordinarily does not retroactively refund the current billing period. You may continue to receive the subscription benefit until the end of the paid period unless law, the purchase disclosure, or an enforcement action provides otherwise.
Before initiating formal proceedings, you may contact service@roost.pet with the transaction details and requested resolution. Roost will review the available purchase record and coordinate with the billing platform where necessary.
The billing platform may issue the official receipt. You are responsible for retaining purchase records needed for tax, reimbursement, or dispute purposes. Roost may retain transaction identifiers and entitlement records as described in the Privacy Policy.
Your payment provider may apply currency conversion or foreign transaction fees. Roost does not control fees imposed independently by your bank, card issuer, mobile carrier, or app store.
Sweepstakes, contests, referral programs, coupons, discounts, trials, and promotional credits may be governed by separate official rules or offer terms. Those rules apply in addition to these Terms.
An offer may be limited by age, account history, country, region, device, billing platform, prior purchase, referral source, or other disclosed criteria. Unless stated otherwise, offers are personal and non-transferable.
Promotional credits are not purchased funds, have no cash value, and may expire under the applicable offer terms. They may be revoked if issued in error or obtained through fraud, automation, multiple accounts, or abuse.
You must not send unsolicited referral messages, misrepresent an offer, create fake referrals, refer yourself through duplicate accounts, or use a referral program for commercial spam.
Roost may modify, suspend, or cancel a promotion when reasonably necessary because of fraud, technical error, legal requirements, or circumstances that undermine the integrity of the offer. Roost will honor rights already earned where required by law.
You are responsible for taxes or reporting obligations arising from a reward where applicable. Promotions are void where prohibited and may be subject to local registration, eligibility, or disclosure requirements.
Unless separate official rules expressly state otherwise and the feature is lawfully offered, Roost virtual items and ordinary promotions do not provide a wager, lottery entry, cash prize, or chance to win real-world value.
The Roost Privacy Policy explains how Roost collects, uses, stores, protects, shares, and otherwise processes personal information. By using the Services, you acknowledge that you have received or can access the Privacy Policy.
The Privacy Policy is a separate document and is not replaced by this Section.
Depending on your use of Roost, information processed may include:
• Account and registration information.
• Profile details and photographs.
• User-Generated Content and messages.
• Video-call and communication metadata.
• Device, network, usage, diagnostic, and security information.
• Approximate location and precise location if separately authorized.
• Purchase, entitlement, and transaction information.
• Reports, complaints, appeals, and support communications.
• Age or identity assurance information if a verification feature is used.
Roost may process information to provide accounts, profiles, recommendations, matching, video calls, messages, follows, purchases, customer support, security, moderation, personalization, analytics, legal compliance, and other purposes described in the Privacy Policy.
Information is retained for periods reasonably necessary to provide the Services, maintain security, investigate abuse, complete transactions, resolve disputes, enforce agreements, comply with law, and establish or defend legal claims.
Specific retention practices, backup periods, deletion timelines, and legal or safety exceptions are described in the Privacy Policy.
Roost may disclose information to other users as necessary for social features, to service providers acting on Roost's behalf, at your direction, to app stores and independent providers, in connection with a business transaction, or to authorities and other recipients where law, safety, or legal process permits or requires.
Depending on your jurisdiction, you may have rights to access, correct, delete, restrict, object to, or obtain a copy of personal information, withdraw consent, opt out of certain processing, request human review, or complain to an authority.
You may use available product controls or contact service@roost.pet. Roost may need to verify your identity and authority before completing a request.
Roost may request device permissions for camera, microphone, selected photographs or media, notifications, and location where a disclosed feature requires it. You may grant, restrict, or revoke permissions through your device settings.
Revoking a permission may disable the associated feature but does not automatically delete information previously collected while the permission was active.
Roost may send operational, transactional, security, safety, and policy communications. With any consent required by law, Roost may also send promotional communications. You may opt out of promotional messages through the provided unsubscribe method.
Roost may process account, content, communication, device, report, and behavioral information to detect underage use, spam, scams, fraud, harassment, CSAE, CSAM, account compromise, and other harmful activity.
Automated tools may assist review, but Roost may use trained personnel or authorized service providers when human assessment is reasonably necessary.
Because Roost is intended for global users, personal information may be processed in countries other than your country of residence. Roost will use transfer safeguards required by applicable law, as described in the Privacy Policy.
You control what you voluntarily show, say, or send to other users. Do not disclose passwords, authentication codes, financial details, government identification numbers, home addresses, or other highly sensitive information in a public profile, message, or video call.
Roost uses reasonable administrative, technical, and organizational measures designed to protect personal information. No internet transmission, storage system, or security measure is completely secure, and Roost cannot guarantee that unauthorized access or loss will never occur.
Privacy Email: service@roost.pet
Privacy requests should clearly identify the account, country or region, right requested, and information reasonably necessary to verify and process the request. Do not send passwords, full payment card numbers, or unnecessary identification documents by email.
Roost may establish and enforce rules designed to protect users, comply with law, maintain platform integrity, and provide a functional social service. Roost may moderate accounts, profiles, UGC, messages, reports, purchase activity, and technical behavior.
Roost may act based on:
• User reports and supporting evidence.
• Automated detection and risk signals.
• Human review.
• Account, device, network, purchase, and usage information.
• Information from authorized service providers.
• Valid legal requests or notices.
• Credible information concerning serious off-platform harm connected to Roost.
Automated systems may identify spam, scams, sexual content, threats, suspected underage users, CSAE, CSAM, malicious links, coordinated abuse, account compromise, or policy evasion.
Authorized reviewers may confirm or correct an automated result, evaluate context, investigate a report, decide an enforcement action, or review an appeal.
Depending on the circumstances, Roost may:
• Warn a user.
• Remove or restrict UGC.
• Limit profile visibility or recommendations.
• Disable messaging, video, matching, purchase, or other features.
• Block a transaction or correct a virtual balance.
• Require age, identity, or account verification.
• Temporarily lock or suspend an account.
• Permanently terminate an account.
• Preserve relevant information.
• Prevent repeated account creation.
• Report conduct or information to authorized recipients.
Roost may consider the nature, context, severity, frequency, and potential impact of conduct; user intent; account history; credible risk; available evidence; legal requirements; and the need to protect users and investigations.
Roost may impose temporary restrictions while investigating a concern. An interim measure is precautionary and does not necessarily represent a final finding.
Where appropriate and legally permitted, Roost may provide notice of an enforcement action and a general reason. Roost may limit, delay, or withhold notice when disclosure could endanger a person, compromise an investigation, reveal confidential security methods, facilitate evasion, violate law, or expose another person's information.
If an appeal is available, the enforcement notice or in-app interface may explain how to submit it. An appeal should identify the decision, explain why it should be changed, and include relevant information that was not previously considered.
An appeal does not automatically stay an enforcement action. Roost may uphold, modify, or reverse the decision after review.
You must not evade an enforcement action by creating or acquiring another account, changing devices, using another person's account, manipulating identifiers, or coordinating with others. Evasion may result in termination of related accounts.
Roost may preserve information connected to fraud, abuse, CSAE, CSAM, threats, account compromise, intellectual property complaints, payment disputes, or other legal matters. Roost may cooperate with lawful investigations and valid legal process.
Except where applicable law requires otherwise, Roost is not liable to compensate you for access, visibility, opportunities, virtual items, or UGC lost because of a lawful enforcement action taken in response to your material breach.
Roost may provide tools to report a user, profile, video interaction, message, transaction, link, or other content. Use the most relevant category and provide accurate information.
A useful report may include:
• The account or content involved.
• The type of suspected violation.
• The approximate date and time.
• Relevant call, message, match, or transaction information.
• A concise description of what occurred.
• Lawfully obtained screenshots or other supporting evidence.
Do not include unrelated sensitive information or create additional copies of prohibited material.
Roost will seek to protect the reporting user's identity where reasonably possible, but cannot guarantee complete confidentiality. Information may need to be disclosed to reviewers, service providers, the reported user, authorities, or other recipients to investigate, explain a decision, protect a person, or comply with law.
Roost support is not an emergency service and may not review a report immediately. If there is an imminent threat to life, a medical emergency, active violence, or a child in immediate danger, contact local emergency services or law enforcement.
For account, purchase, privacy, safety, or technical assistance, contact service@roost.pet or use available in-app support. Include enough information to identify the issue, but do not send passwords, authentication codes, or full payment card numbers.
Where an appeal is available, submit it through the method stated in the notice or contact service@roost.pet. Repeated identical appeals, abusive messages, threats, or attempts to overwhelm support systems may be restricted.
For a purchase processed by an app store, you may also need to contact that store. Provide the transaction reference, date, product, price, account identifier, and requested resolution.
You must not knowingly submit false evidence, impersonate a complainant, coordinate mass reports, or use reporting tools to harass, retaliate, gain a competitive advantage, or silence lawful expression.
Roost will seek to respond within a reasonable period and within any deadline required by law. Complex investigations, identity verification, external-provider coordination, or legal restrictions may require additional time.
Nothing in these Terms prevents you from contacting a consumer protection, data protection, law enforcement, or other competent authority. You are not required to waive a mandatory legal right before Roost reviews a complaint.
Users or Roost may provide links to independent websites, applications, files, products, or services. Roost does not control and is not responsible for the content, availability, legality, privacy, security, or practices of an independent third party.
Use caution before opening a link or providing information to an external service. A link does not imply endorsement, affiliation, or a guarantee by Roost.
Roost may allow you to use third-party services for authentication, payment, communication infrastructure, media selection, sharing, analytics, support, verification, or other functions.
When you choose an integrated service, Roost and the provider may exchange information necessary to complete your request. The provider may independently process information under its own terms and privacy policy.
Your download, installation, update, purchase, subscription, refund, and use of an app store are governed by the store operator's terms. These Terms are between you and Roost, not the app store, except to the extent the store's terms create third-party beneficiary rights.
The app store is not responsible for operating Roost, providing Roost support, or resolving claims concerning the Services, except as required by the store's own terms or applicable law.
If you connect a third-party account, you authorize Roost to use the information made available according to your settings and the provider's authorization notice. You may disconnect the account through available controls, but information already processed may be retained as described in the Privacy Policy.
Your device manufacturer, operating-system provider, mobile carrier, internet provider, and network operator may independently collect information and impose charges or restrictions. Roost does not control their services.
A third party may offer products, services, advertisements, or promotions through or in connection with Roost. Unless Roost expressly states otherwise, the third party is responsible for fulfillment, warranties, refunds, and customer support for its offer.
Although Roost does not control independent services, it may investigate external conduct connected to a Roost account when credible information indicates fraud, harassment, stalking, threats, CSAE, CSAM, trafficking, payment abuse, or another serious violation affecting the Services or users.
If a conflict concerns a third party's independent product, transaction, or account, that provider's terms will govern its service, while these Terms continue to govern your use of Roost.
You may stop using Roost at any time. If account deletion is available, you may initiate it through the account or privacy settings, an external deletion page linked from the app store listing, or by contacting service@roost.pet when another method is unavailable.
Deleting the App, logging out, revoking a permission, or allowing a subscription to expire does not by itself delete your account.
Roost may restrict, suspend, or terminate your access when reasonably necessary to:
• Address a breach of these Terms or an incorporated policy.
• Protect users or another person from harm.
• Investigate fraud, abuse, underage use, CSAE, CSAM, or account compromise.
• Prevent evasion or repeated violations.
• Respond to legal process or a regulatory requirement.
• Protect the security or integrity of the Services.
• Address nonpayment, chargeback abuse, or unauthorized purchases.
• Discontinue the Services or a relevant feature.
Roost may act without advance notice in urgent or serious circumstances, including suspected child exploitation, credible violence, trafficking, sextortion, active fraud, malware, account compromise, evidence destruction, or a legal prohibition on notice.
During a suspension, you may lose access to your profile, recommendations, matching, video calls, messages, purchases, virtual items, or other features. Roost may preserve the account and relevant information while the matter is reviewed.
Termination ends your license to use the Services. Roost may remove your public profile, end active sessions, disable communications, remove you from recommendations, and delete or de-identify account information subject to the Privacy Policy and applicable retention exceptions.
Termination for a material violation may result in loss of unused virtual items or remaining access to Paid Features to the extent permitted by law. If Roost terminates the Services without cause and a prepaid benefit cannot be provided, Roost will provide any remedy required by applicable law.
You remain responsible for separately canceling a subscription billed by an app store unless the store confirms that cancellation occurred automatically.
Account deletion or termination may not remove messages delivered to another user, content copied outside Roost, transaction records, safety reports, legal records, or information another person is entitled or required to retain.
After a verified deletion request, Roost will begin deletion without undue delay. Information will generally be removed from active systems within the period stated in the Privacy Policy. Restricted backups and information subject to legal or safety exceptions may remain longer.
Roost may verify that a deletion request was submitted by the account owner or an authorized representative. If ownership cannot reasonably be verified, Roost may request additional information or decline to complete the deletion.
If an appeal is available for a termination decision, follow the method in the notice or contact service@roost.pet. Questions concerning account deletion may be sent to the same address.
If Roost permanently terminates your account for a material violation, you may not create, acquire, or use another account without written permission. Roost may terminate related accounts used for evasion.
Provisions that by their nature should survive termination will continue, including provisions concerning intellectual property, UGC licenses needed for retained copies, purchases, refunds, enforcement records, disclaimers, liability, indemnification, disputes, and general legal terms.
To the maximum extent permitted by law, the Services are provided on an "as is" and "as available" basis. Roost disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, and any warranty arising from course of dealing or usage of trade.
Roost does not warrant that the Services will be uninterrupted, secure, error-free, compatible with every device, or free from harmful components. Roost does not guarantee any number of recommendations, matches, calls, messages, followers, responses, relationships, or other outcomes.
Users control their own profiles, communications, and conduct. Roost does not guarantee that a user's identity, age, photographs, statements, intentions, availability, location, background, or behavior is accurate or safe.
You assume the risks ordinarily associated with communicating with strangers online and, if you choose, meeting them offline.
Unless Roost expressly states otherwise for a specific feature, Roost does not conduct comprehensive criminal, identity, employment, education, health, or financial background checks. Verification, recommendation, ranking, matching, moderation, or account availability is not an endorsement.
Roost does not endorse UGC and is not responsible for the accuracy, legality, reliability, or quality of content created by users. Moderation reduces some risk but cannot identify every violation or prevent every harmful interaction.
Roost is not an emergency service, law enforcement agency, medical provider, mental health provider, financial adviser, legal adviser, employment service, or background screening agency. Information available through the Services is not professional advice.
Roost makes no warranty concerning an independent app store, payment provider, authentication provider, telecommunications network, external link, advertisement, or third-party product.
Roost uses reasonable safeguards but cannot guarantee that unauthorized access, interception, loss, misuse, alteration, or disclosure will never occur. You are responsible for protecting your device and credentials and for promptly reporting suspected compromise.
Experimental, test, preview, or beta features may be incomplete, changed, or discontinued and may contain errors. Use them at your own discretion, subject to mandatory legal rights.
Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, the exclusions in this Section apply only to the maximum extent permitted. Nothing in these Terms limits a statutory guarantee that cannot be waived.
To the maximum extent permitted by law, Roost and its affiliates, officers, directors, employees, agents, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business, opportunity, goodwill, data, or anticipated savings, arising from or related to the Services or these Terms.
To the maximum extent permitted by law, Roost is not liable for harm caused by the acts, omissions, content, communications, representations, transactions, or offline conduct of a user or independent third party, except to the extent the harm is legally attributable to Roost and liability cannot be excluded.
To the maximum extent permitted by law, Roost's aggregate liability for all claims arising out of or relating to the Services or these Terms will not exceed the greater of:
• The amount you paid directly to Roost or through an app store for the Services during the 12 months immediately preceding the event giving rise to the claim.
• Fifty United States dollars, or the equivalent in local currency.
This cap does not apply where applicable law requires a higher amount or prohibits the cap.
Nothing in these Terms excludes or limits liability for:
• Death or personal injury caused by negligence where such liability cannot be limited.
• Fraud or fraudulent misrepresentation.
• Willful misconduct or gross negligence where limitation is prohibited.
• Violation of a non-waivable consumer right.
• Any other liability that applicable law does not permit the parties to exclude or limit.
The disclaimers and limitations in these Terms allocate risk between you and Roost and are a material basis on which the Services are offered, including where a remedy fails of its essential purpose.
Some jurisdictions do not allow the exclusion of certain damages or limits on liability. In those jurisdictions, Roost's liability will be limited to the fullest extent permitted by applicable law.
You agree to take reasonable steps to reduce avoidable loss and to notify Roost promptly when you become aware of a problem that could cause continuing harm. This provision does not shorten a mandatory legal limitation period.
Roost is not liable for delay or failure caused by events beyond its reasonable control, including natural disasters, war, terrorism, civil unrest, epidemics, government action, labor disputes, internet or power failures, telecommunications outages, cyberattacks, app store failures, or service-provider disruptions, except where law requires otherwise.
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Roost and its affiliates, officers, directors, employees, agents, licensors, and service providers from third-party claims, liabilities, losses, judgments, damages, costs, and reasonable legal fees arising from:
• Your UGC.
• Your unlawful or unauthorized use of the Services.
• Your material breach of these Terms or an incorporated policy.
• Your infringement or violation of another person's rights.
• Your fraud, willful misconduct, or illegal conduct.
• A transaction or interaction that you conduct independently with another user or third party.
Roost will provide reasonable notice of an indemnified claim where practicable. Roost may control the defense and settlement, and you agree to provide reasonable cooperation.
You may participate through counsel at your own expense. You may not settle a claim in a manner that admits liability by Roost, imposes an obligation on Roost, or fails to provide a complete release without Roost's written consent.
The indemnity does not apply to the extent a claim results from Roost's own unlawful conduct or where applicable consumer law prohibits the obligation.
If you use Roost solely as an individual consumer, this Section applies only to the extent enforceable under the law of your jurisdiction.
This Section allocates responsibility between you and Roost and does not create a right for an unrelated third party to enforce these Terms except where expressly stated.
Before filing a formal claim, you and Roost agree to make a good-faith effort to resolve the dispute informally, unless urgent relief, a statutory deadline, or applicable law makes informal resolution impracticable.
Send a written notice to service@roost.pet containing:
• Your name and Roost account identifier.
• A description of the dispute.
• The relevant dates, transactions, or communications.
• The remedy requested.
• Information reasonably necessary to evaluate the claim.
Roost may request a reasonable discussion or provide a written response. This informal process does not require you to waive a mandatory right or contact Roost before complaining to a regulator where law permits direct complaints.
Except where mandatory law provides otherwise, these Terms are governed by the laws of the jurisdiction in which the legal entity identified as the provider of Roost in the applicable app store listing is established, without regard to conflict-of-law rules.
The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Except where applicable consumer law allows or requires proceedings elsewhere, a dispute that cannot be resolved informally may be brought in the competent courts of the jurisdiction where the Roost provider is established.
You may also have the right to bring a claim in the courts of your country, state, province, or region of residence. Nothing in these Terms deprives you of that right where it is mandatory.
You may use a consumer protection procedure, small-claims process, regulatory complaint, online dispute resolution mechanism, or other remedy available under applicable law. Roost does not require you to waive a non-waivable remedy.
These Terms do not impose mandatory arbitration unless a separate regional notice or feature-specific agreement expressly states that arbitration applies and the agreement is valid under applicable law. If no such separate agreement exists, disputes may proceed in a competent court.
Either party may seek temporary, injunctive, or protective relief from a competent court to prevent imminent harm, unauthorized access, infringement, evidence destruction, disclosure of confidential information, or other irreparable injury.
A claim must be brought within the limitation period provided by applicable law. No shorter contractual period applies where it would unlawfully restrict a consumer or statutory right.
Unless applicable law or a valid separate agreement provides otherwise, claims will be resolved according to the procedural rules of the competent forum. These Terms do not create a class-action waiver or jury-trial waiver where one has not been separately and lawfully agreed.
The language of a proceeding will be determined by the competent forum and applicable law. Roost may provide translations for convenience, but the English version of these Terms controls to the extent permitted by law.
Roost may update these Terms to reflect:
• New or modified features.
• Changes to paid products or billing practices.
• Safety, moderation, or security improvements.
• Legal, regulatory, or app store requirements.
• Changes in technology, service providers, or business operations.
• Clarifications or corrections.
If an update materially affects your rights or obligations, Roost will provide notice appropriate to the change, which may include an in-app notice, email, website announcement, updated effective date, or notice displayed when you next access the Services.
Where law requires express consent, Roost will request it before the relevant change applies.
The updated Terms will state an effective date. Non-material changes may take effect when posted. Material changes will take effect after any notice period required by law.
If you continue using the Services after updated Terms take effect, that continued use constitutes acceptance where legally valid. If you do not agree, you must stop using Roost and may request account deletion.
Roost may add, modify, limit, suspend, or discontinue a feature or the Services. Roost will consider prepaid commitments and mandatory consumer rights when a change affects a Paid Feature.
Roost may change prices for future purchases. A subscription price change will be communicated and implemented in accordance with app store rules and applicable law. The change will not retroactively alter a completed one-time purchase.
You should retain a copy of the Terms and purchase disclosures that apply to your transaction. Roost may retain prior versions and acceptance records as necessary for legal and compliance purposes.
Roost may provide translated versions of these Terms. If a translation conflicts with the English version, the English version will control to the extent permitted by applicable law.
These Terms, together with the Privacy Policy, Community Guidelines, child safety standards, purchase disclosures, and any applicable feature-specific or regional terms, constitute the agreement between you and Roost concerning the Services.
They supersede prior oral or written understandings concerning the same subject, except for a separate agreement expressly stated to remain in effect.
If provisions conflict, the following order applies to the extent relevant:
• Mandatory applicable law.
• A feature-specific purchase or regional term for its stated subject.
• These Terms.
• General guidance or help-center content.
The Privacy Policy controls descriptions of personal information processing, while these Terms control use of the Services.
You may not assign or transfer these Terms or your account without Roost's written consent. Roost may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, corporate restructuring, or transfer of the Services, subject to applicable law and required notice.
A failure or delay in enforcing a provision is not a waiver. A waiver is effective only if made in writing by an authorized representative and applies only to the specific circumstance stated.
If a provision is held invalid or unenforceable, it will be modified to the minimum extent necessary to make it enforceable or, if modification is not possible, severed. The remaining provisions will continue in effect.
These Terms do not create an employment, agency, partnership, franchise, joint venture, fiduciary, or representative relationship between you and Roost.
Except for app store beneficiary rights or indemnified parties expressly identified in these Terms, no person who is not a party has a right to enforce these Terms unless applicable law provides otherwise.
Roost may provide notices through the App, email, a website, the applicable app store listing, or another legally permitted method. You are responsible for maintaining current contact information and reviewing notices made available through the Services.
Legal notices to Roost may be sent to service@roost.pet unless a specific notice provides another address.
You consent to receive agreements, disclosures, receipts, and notices electronically where permitted by law. You may retain electronic communications by saving or printing them.
Headings are for convenience and do not limit the meaning of a provision. "Including" means "including without limitation." A reference to law includes amendments and successor provisions. Singular words include the plural where context requires.
Roost seeks to present these Terms in a clear and accessible form. If you require an alternative format because of a disability or accessibility need, contact service@roost.pet.
App: Roost
Service and Legal Email: service@roost.pet
Privacy Email: service@roost.pet

To help Roost respond efficiently, include:
• A clear description of the request or complaint.
• The email address or telephone number associated with the account.
• Your country or region.
• The relevant account, content, interaction, purchase, or incident information.
• The transaction reference for a billing issue.
• The remedy or response requested.
Do not send passwords, authentication codes, full payment card numbers, unnecessary identification documents, or unrelated sensitive information by email.
Roost will review complaints in good faith and may confirm receipt, request information, investigate relevant records, consult service providers, explain the outcome, take reasonable corrective action, and provide information about an appeal or regulatory complaint right where required.
These Terms are effective as of August 13, 2026 and remain in effect until replaced by an updated version.
